Definitions
“Website” is the website of SP at snappedpixel.co.uk or any other website owned and operated by the company.
“Member” is the person named on the membership sign-up form on the site.
“Student” is the person named on the course sign-up form on the site.
“Course Materials” are all information provided by SP with a course provided for purchase by the SP in any form including but not limited to electronic documents, video, or images.
“Abusive behavior/language” includes the following: any form of discrimination; any form of harrassment; bullying or verbal abuse (in person or writing).
“Our service” is the provision of informational articles and courses related to photography and connected activities.
Articles and Course Content
Course and membership descriptions are available on our website, together with prices. We will endeavour to ensure these are accurate and timely updated to reflect updated service offerings. However, there may be delays and information may not always be accurate, complete and current. Please let us know if you have any concerns about our materials and services.
SP reserves the right to alter or withdraw any course or marketing materials to correct errors, inaccuracies, or omissions at any time without prior notice.
Refunds
Courses: you are allowed 14 days to request a refund on a course that you have paid for but not started. However, once a course is started we cannot offer refunds. If there is a fault with the course we will correct it.
Site memberships: we do not offer refunds on site memberships but you can cancel your monthly subscription at any time.
Permissions
Upon purchase of SP’s memberships or courses, you give SP permission to your comments, reviews or other contributions for the purpose of promoting the SP’s courses. This includes any post shared in our social media. You waive any right to inspect or approve our promotional materials, including a where the testimonial appears.
Testimonials may be used in digital or printed publications, presentations, websites, social media, or in other communications. You agree that you will make no claim for their use.
Posting of user content
Our Service allows you to post comments, which may include links and attachments (“Content”). You are responsible its appropriateness and legality. By posting content, you confirm that you own it or have the right to use it and allow us to use it on the site. You confirm that the content does not violate copyrights, privacy rights, publicity rights,, contract rights or other rights of any person.

You may use the content from the SP’s courses and/or website only for personal, non-commercial use. You may not copy, reproduce, duplicate, distribute, disseminate, publish, post, display, modify, upload to, or in any way exploit any content from the SP’s courses or website. Social media and site posts: treat others with kindness and respect. Do not post offensive topics or act aggressively. Support and encourage through SP’s forums. SP reserves the right to remove inappropriate comments and block persistent offenders.

SP retains full copyright in all images, at all times, throughout the world, in accordance with the Copyright, Designs and Patents Act 1988 (the Acts). Except, alternative copyright holders are specified against featured images. The blog asserts his right to be identified as the author of all images, by the words: ‘Photographs by Fitzgibbon Photography’. It is contrary to the Acts, and illegal, to copy images, or allow to them to be copied, by any means photographic, by computer, or internet or otherwise, by any person or machine other than by the Blog or within an agreement granted by the Blog.

Force Majeure and Limitation of Liability

In no event shall SP nor its directors, staff or guest writers be liable for any damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any conduct or content of any third party on the Service; and (c) any content obtained from the Service.
Governing Law
This contract will be governed and construed in accordance with the laws of England and Wales. In the event of any dispute regarding this contract, both parties agree to attempt to obtain a conciliation before taking any other action.

We reserve the right to modify or replace these Terms at any time. If a revision is significant we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a significant change will be determined by us.
